THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS YOU MUST READ AND UNDERSTAND IT BEFORE INITIALING OR SIGNING
DUTY OF THE PARTICIPANTS: It is recognized that recreational activities conducted by Pusch Ridge Stables are hazardous to participants regardless of all feasible safety measures that we can take.
All participants shall have a duty to act as a reasonably prudent person when engaging in the recreational
activities which are offered by Pusch Ridge Stables, referred to hereafter as the stables. I hereby covenant and agree not to:
(A) On any act which shall interfere with the running or operation of the stables, when such activities conform to the rules and regulations of the State of Arizona.
(B) Use any of the stables equipment or facilities or services if I do not have the ability to use such facilities, equipment, or services safely without instructions until I have requested and received sufficient instructions to permit safe usage.
(C) Engage in any harmful conduct or willingly, or negligently engage in any type of conduct which contributes to as causes injury to any person.
(D) To embark in any self-initiated activity without first informing the stables of my intentions and receiving permission from the stables to engage in such self-initiated activity.
ACKNOWLEDGEMENT AND ACCEPTANCE OF RISK: I understand and acknowledge that the activity that I am about to voluntarily engage in as a participant and/or volunteer bears certain known risks and unanticipated risks which could result in injury, death, illness or diseases, physical or mental, or damage to myself, to any property, or to spectators or other third-parties. I, being aware that this activity entails risks or injuries to myself and a risk or injury to spectators or third parties as a result of my actions, expressly agree, covenant and promise to accept and assume all responsibility and risk for injury, death, illness, or diseases, or damage to myself or to my property arising from my participation in this activity. I also agree to pay for any damages caused to others (including attorney’s fees and costs) if they are injured or otherwise damaged due to any negligent actions. My participation in this activity is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of the known and unknown risks.
RELEASE: In consideration of the services and/or property provided, I, for myself and any minor children for which I am the parent, legal guardian, or otherwise responsible, my heirs, personal representatives, or assigns, do hereby release the stables, its principles, directors, officers, agents, employees, and volunteers from any liability and waive any claim for damages arising from any cause whatsoever (except that which is gross negligence). I further agree to reimburse you for all attorneys’ fees and costs should I bring a legal action against you and lose.
ENTIRE AGREEMENT: I understand that this is the entire Agreement between myself and the stables, its agents or employees, and that it cannot be modified or changed in any way by the representations or statements of any employee of the stables or by me.

LIMITATIONS OF ACTIONS ARTICLE 3. PERSONAL ACTIONS
A.R.S. 12-553 (1994)
12-553. Limited liability of equine owners;exceptions;definitions
A. An equine owner or an agent of an equine owner who regardless of consideration allows another person to take control of an equine is not liable for an injury to or the death of the person if:
1. The person has taken control of the equine from the owner or agent when the injury or death occurs.
2. The person or the legal guardian of the person if the person is under eighteen years of age has signed a release before taking control of the equine.
3. The owner or agent has properly installed suitable tack or equipment or the person has personally tacked the equine with tack the person owned, leased or borrowed. If the person has personally tacked the equine, the person assumes full responsibility for the suitablility, installation, and condition of the tack.
4. The owner of agent assigns the person to a suitable equing based on a reasonable interpertation of the person’s representation of his skills, health, and experience with and knowledge of equines.
B. Subsection A does not apply to an equine owner or agent of the equine owner who is grossly negligent or commits willful, wanton or intentional acts or omissons.
C. As used in this section:
1. “Equine” means a horse, pony, mule, donkey, or ass.
2. “Release” means a document that a person signs before taking control of an equine from the owner or owner’s agent. A signed release acknowledges that the person is aware of the inherent risks associated with equine activities, is willing and able to accept full responsibility for his own safety and welfare and releases the equine owner or agent from liability unless the equine owner or agent is grossly negligent or commits willful, wanton or intentional acts or omissions.
